Real Case Studies: How the Numbers Come Together for Construction Workers

The elements above can feel abstract until you see how they play out in an actual claim. Below are two matters our firm handled for injured workers with knee injuries. To protect our clients’ privacy, we have removed all names and identifying details and describe the facts in general terms.

Case Study 1: Fighting a Wrongful Temporary Disability Cutoff — and Winning a Penalty

The Injury

Our client, a construction worker, injured his right knee on the job in October 2022. The knee required arthroscopic surgery, and a Qualified Medical Evaluator confirmed the client was not yet at maximum medical improvement and still needed treatment.

The Problem

When the employer could not accommodate the client’s work restrictions in late 2023, he was forced off work entirely. Rather than pay the temporary disability benefits he was owed, the insurance carrier denied and delayed those payments. To keep food on the table, our client had to fall back on state disability (EDD) benefits, which pay less than the workers’ comp temporary disability rate he was entitled to.

Our Approach

We filed a Petition for Penalty under Labor Code section 5814 for the carrier’s unreasonable delay, together with a Declaration of Readiness to Proceed to an expedited hearing so the client would not have to wait months for relief. At the hearing in January 2024, the judge found that the carrier’s claim the client had reached maximum medical improvement had been successfully rebutted and that the delay in paying benefits was unreasonable.

The Result

The resolution put real dollars back in our client’s pocket and restored his benefits going forward:

  • A 20% penalty on the wrongfully delayed temporary disability: approximately $4,297.
  • Recovery of the difference between the higher workers’ comp rate (about $1,513 per week) and the lower EDD amount he had been forced to accept: approximately $2,339.
  • Temporary disability reinstated on an ongoing basis at roughly $1,513 per week, and protected against an improper cutoff.
  • Reimbursement of the EDD lien (over $19,000) resolved so the client kept the benefit of both payment streams for the correct periods.

The Takeaway

When a carrier cuts off or lowballs temporary disability, the loss is not always permanent. A well-supported penalty petition and an expedited hearing can both restore benefits and add a penalty on top of what was wrongly withheld.

Case Study 2: Overturning a Utilization Review Denial to Get a Knee Surgery Approved

The Injury

In a separate matter, our client suffered a work-related left knee injury in early 2025 that required a partial meniscectomy (surgery to repair a torn meniscus).

The Problem

The carrier’s utilization review process modified or denied several of the treatment requests. Most critically, it denied the pre-operative medical clearance and reduced or blanked out the labs, EKG, chest X-ray, and other pre-surgical testing the treating surgeon needed. Without those approvals, the surgeon’s office could not schedule the surgery, leaving our client in pain and in limbo.

Our Approach

We attacked the denial on two fronts. First, we invoked the client’s right to challenge a utilization review decision through Independent Medical Review under Labor Code sections 4610.5 and 4610.6. At the same time, we contacted defense counsel and the claims adjuster directly and pushed for an adjuster override of the utilization review denial, then coordinated closely with the surgeon’s office to confirm exactly which authorizations and date ranges were still needed so nothing would slip through the cracks.

The Result

Our persistence paid off. The carrier issued an override authorizing the previously denied medical clearance and extended the authorizations, ultimately clearing the way for the pre-operative workup and the knee surgery to move forward. We also stayed on top of the client’s temporary disability payments throughout, chasing down a lapse and getting benefits extended when a missed follow-up appointment threatened to stop the checks.

The Takeaway

A utilization review “denial” is rarely the last word. Between Independent Medical Review, direct advocacy with the adjuster, and diligent coordination with the treating physician, denied surgeries and testing can be gotten back on track, and delayed benefits restored.
